<p>These Terms and Conditions ("Terms") govern your use of <a href="https://dmgmotorsports.com/">https://dmgmotorsports.com/</a> (the "Site") and your purchase of products from Discount Moto Gear LLC, doing business as DMG Motorsports ("DMG Motorsports," "we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.</p>

<h2>1. Eligibility</h2>
<p>You must be at least 18 years old, or the age of majority in your state, to make a purchase on the Site. By using the Site, you represent that you meet this requirement.</p>

<h2>2. Products, Fitment, and Descriptions</h2>
<ul>
  <li>We work to keep product descriptions, images, specifications, and fitment data accurate, but we do not warrant that they are complete, current, or error-free. Product images may differ slightly from the actual product.</li>
  <li><strong>Fitment is your responsibility to verify.</strong> Vehicle fitment data is provided as a convenience and is based on information supplied by manufacturers and distributors. Before installing any part, confirm compatibility with your specific vehicle's make, model, year, and trim. We are not responsible for damage resulting from installation of an incompatible part.</li>
  <li>Some products are intended for closed-course or off-road use only and may not be legal for use on public roads or may affect emissions compliance in certain states (including California). You are responsible for knowing and complying with the laws that apply to you.</li>
  <li>Powersports activities are inherently dangerous. Products sold on the Site do not eliminate the risk of injury or death. Always use appropriate protective gear and follow the manufacturer's instructions for installation, use, and maintenance. Installation by a qualified professional is recommended where applicable.</li>

<h2>3. Pricing and Errors</h2>
<p>All prices are in U.S. dollars and are subject to change without notice. Despite our efforts, occasionally a product may be listed at an incorrect price or with incorrect information. We reserve the right to refuse or cancel any order placed for a product listed at an incorrect price, whether or not the order has been confirmed and your payment charged. If your payment has already been charged and we cancel your order, we will issue a full refund.</p>

<h2>4. Orders and Payment</h2>

  <li>Your order is an offer to purchase. We reserve the right to accept, refuse, or cancel any order for any reason, including suspected fraud, product unavailability, or pricing errors.</li>
  <li>Payments are processed by our third-party payment providers (Square and Amazon Pay). By submitting payment information, you represent that you are authorized to use the payment method provided.</li>
  <li>We may collect sales tax where required by law.</li>

<h2>5. Shipping and Risk of Loss</h2>
<p>Shipping is governed by our <a href="/shipping/">Shipping Policy</a>. Orders over $100 shipped to the contiguous United States qualify for free Standard Shipping. Shipping times are estimates quoted in business days, not guarantees. Most in-stock items ship the same business day; some items ship directly from our distributors or manufacturers and may arrive in separate shipments. International orders are quoted individually. Title and risk of loss pass to you upon our delivery of the products to the carrier. If your order arrives damaged, contact us at 949-404-0873 or <a href="mailto:support@discountmotogear.com">support@discountmotogear.com</a> promptly so we can assist with a carrier claim.</p>

<h2>6. Returns and Refunds</h2>
<p>Returns are governed by our <a href="/return-and-refund-policy/">Return and Refund Policy</a>. In general:</p>

  <li>New, unused, and unaltered items in original packaging with all tags may be returned within 30 days of delivery for a full refund to the original payment method.</li>
  <li>All helmet sales are final.</li>
  <li>You are responsible for return shipping costs. There are no restocking fees, except a 10% restocking fee on canceled electric bike orders (waived if the item arrived damaged).</li>
  <li>Refunds are processed after the returned item is received and inspected, usually within 24 hours of receipt; your card issuer may take an additional 2–10 business days to post the credit.</li>
</ul>

<h2>7. Manufacturer Warranties</h2>
<p>All products sold on the Site are brand new and covered by the applicable manufacturer's warranty. We do not sell used, refurbished, overstock, sample, or red-tag merchandise. Warranty claims are handled by the manufacturer under the terms of that warranty. Except as expressly stated, DMG Motorsports provides no independent warranty of its own.</p>

<h2>8. Disclaimer of Warranties</h2>
<p>THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.</p>

<h2>9. Limitation of Liability</h2>
<p>TO THE FULLEST EXTENT PERMITTED BY LAW, DMG MOTORSPORTS AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR LOSS OF USE) ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED THROUGH IT. IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. SOME STATES DO NOT ALLOW THE LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.</p>

<h2>10. Indemnification</h2>
<p>You agree to indemnify and hold harmless DMG Motorsports from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your improper installation or use of any product purchased through the Site.</p>

<h2>11. Intellectual Property</h2>
<p>All content on the Site — including text, product data, images, logos, and design — is owned by DMG Motorsports or its licensors and is protected by copyright, trademark, and other laws. You may not copy, scrape, reproduce, or distribute Site content without our prior written permission. Manufacturer names, part numbers, and logos are used for identification purposes only and remain the property of their respective owners.</p>

<h2>12. User Conduct</h2>
<p>You agree not to use the Site for any unlawful purpose, attempt to gain unauthorized access to our systems, interfere with the Site's operation, use automated tools to scrape or harvest data, or submit false or fraudulent information (including reviews and orders).</p>
