This Privacy Policy describes how Discount Moto Gear LLC, doing business as DMG Motorsports ("DMG Motorsports," "we," "us," or "our"), collects, uses, and shares personal information when you visit or make a purchase from https://dmgmotorsports.com/ (the "Site").
The short version: We collect the information needed to process your orders, ship your products, provide customer service, and advertise our store. We do not sell your personal information for money. We do use common advertising and analytics tools (like Google Analytics, Google Ads, and Meta/Facebook) that may be considered "sharing" under California law, and you can opt out of that at any time — see Your California Privacy Rights and How to Opt Out of Cookies, Tracking, and Targeted Advertising below.

When you visit the Site, we and our service providers automatically collect certain information about your device and browsing activity, including IP address, browser type, device type, operating system, pages viewed, referring URLs, and general location (city/state derived from IP address). This information is collected using cookies, pixels, and similar technologies described in Section 4.

3. How We Share Your Information
We do not sell your personal information for money, and we do not share it with third parties for their own independent marketing. We share personal information only as described below:
- E-commerce platform: our Site runs on BigCommerce, which hosts our store and processes order data on our behalf (BigCommerce Privacy Policy).
- Payment processors: Square (Privacy Policy) and Amazon Pay (Privacy Policy) process payments you make on the Site.
- Email marketing: we use Klaviyo to send transactional and marketing emails (Klaviyo Privacy Policy).

- Advertising and remarketing: we use Google Ads and Meta (Facebook/Instagram) advertising services, which use cookies and pixels to show our ads to people who have visited our Site. Under California law, this type of cross-context behavioral advertising may be considered "sharing" of personal information, and you have the right to opt out (see Sections 6 and 7).
- Shipping carriers and suppliers: we share your name, shipping address, and order contents with shipping carriers and, where applicable, the distributors or manufacturers who fulfill your order.
- Legal and safety: we may disclose information to comply with applicable law, respond to lawful requests, protect our rights, or prevent fraud.
- Business transfers: if we are involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction.
4. Cookies and Tracking Technologies
We use the following categories of cookies and similar technologies:
- Strictly necessary cookies: required for the Site to function (shopping cart, checkout, login, security). These cannot be disabled.
- Analytics cookies: Google Analytics cookies that help us understand how visitors use the Site.
- Advertising cookies and pixels: Google Ads and Meta (Facebook) tags that allow us to measure ad performance and show ads to people who have visited our Site.
- Functional cookies: remember your preferences, such as saved vehicles for fitment lookups.
See Section 7 for how to manage or opt out of cookies and tracking.
5. How Long We Keep Your Information
We keep personal information for as long as needed for the purposes described in this policy — for example, order records are retained as required for tax, accounting, warranty, and legal purposes. When information is no longer needed, we delete or de-identify it.
6. Your California Privacy Rights (CCPA/CPRA)
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), gives you the following rights:
- Right to Know: request that we disclose the categories and specific pieces of personal information we have collected about you, the sources, the purposes for collection, and the categories of third parties with whom it is shared.
- Right to Delete: request that we delete personal information we have collected from you, subject to certain exceptions (for example, information we must keep to complete your order, prevent fraud, or comply with law).
- Right to Correct: request that we correct inaccurate personal information.
- Right to Opt Out of Sale or Sharing: we do not sell personal information for money. However, our use of targeted advertising tools may be considered "sharing" under the CPRA. You may opt out of this sharing at any time (see Section 7).
- Right to Limit Use of Sensitive Personal Information: we do not use or disclose sensitive personal information for purposes beyond those permitted by the CCPA/CPRA.
- Right to Non-Discrimination: we will never deny you goods or services, charge you a different price, or provide a different level of service because you exercised your privacy rights.
Categories of personal information collected (last 12 months)
- Identifiers (name, email, phone number, address, IP address)
- Commercial information (orders, purchase history)
- Internet or network activity (browsing behavior on our Site)
- Approximate geolocation (city/state derived from IP address)
- Inferences drawn from the above (for example, product interests used for advertising)
How to exercise your rights
To submit a request to know, delete, or correct, email us at support@discountmotogear.com with the subject line "Privacy Request." We may need to verify your identity before fulfilling your request, typically by matching information you provide (such as your name, email address, and a recent order number) against our records. You may also designate an authorized agent to submit a request on your behalf; we will require proof of the agent's authority.
We will confirm receipt of your request within 10 business days and respond within 45 calendar days. If we need more time (up to an additional 45 days), we will let you know.
7. How to Opt Out of Cookies, Tracking, and Targeted Advertising
You can opt out of non-essential cookies, tracking, and the "sharing" of your information for targeted advertising in any of the following ways:
- Your Privacy Choices page: visit our Your Privacy Choices page and click "Do Not Sell or Share My Personal Information."
- Global Privacy Control (GPC): we honor the Global Privacy Control browser signal. If your browser or extension sends a GPC signal, we treat it as a valid request to opt out of sale/sharing for that browser. Learn more at globalprivacycontrol.org.
- Email us: send a request to support@discountmotogear.com with the subject line "Do Not Sell or Share My Personal Information."
- Browser settings: most browsers let you block or delete cookies. Blocking strictly necessary cookies may prevent checkout from working.

- Meta (Facebook/Instagram) ad preferences: adjust your settings at facebook.com/adpreferences.
- Industry opt-out tools: visit the Digital Advertising Alliance at optout.aboutads.info or the Network Advertising Initiative at optout.networkadvertising.org.

8. Do Not Track and CalOPPA Disclosures
In accordance with the California Online Privacy Protection Act (CalOPPA):
- Users can visit our Site anonymously.
- A link to this Privacy Policy is available in the footer of our Site.
- We will notify users of material changes to this Privacy Policy by updating the "Last Updated" date on this page.
- Some browsers offer a "Do Not Track" (DNT) setting. There is no industry standard for responding to DNT signals, so our Site does not respond to DNT signals at this time. We do, however, honor the Global Privacy Control signal as described in Section 7.
9. Children's Privacy
Our Site is not directed to children, and we do not knowingly collect personal information from anyone under the age of 13. If you believe a child under 13 has provided us with personal information, contact us at support@discountmotogear.com and we will delete it.
10. Security
We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including encrypted (HTTPS) connections and PCI-compliant payment processing through our payment providers. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security.
11. Other U.S. State Privacy Rights
Residents of other U.S. states with comprehensive privacy laws (such as Virginia, Colorado, Connecticut, Utah, Texas, and Oregon) may have similar rights to access, correct, delete, and opt out of targeted advertising. Residents of any state may submit a request using the contact information below, and we will honor applicable rights under the law of your state.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the updated policy.
